Terms and Conditions

These Digicel “Chwazi Pou Genyen Christmas 2024” Promotion (the “Promotion”) Frequently asked Questions (“FAQs”) and Terms and Conditions (the “Terms”) apply to you and govern your participation in the Promotion for a chance to win prizes during the promotional period. You should read these FAQs and Terms carefully before participating in the Promotion.

“We” or “us” means Unigestion Holding S.A. (« Digicel Haïti »), a company registered under the laws of Haïti with registered offices at # 151, Av. Jean Paul II & Impasse Duverger, Turgeau, Port-au-Prince, Haïti. References to “we”, “our” and “us” in these Terms includes our subsidiaries and affiliates (“Affiliates”) from time to time. “I” or “You” means the person participating in the Promotion (and “my” and “your” shall have the same meaning).

By participating in the Promotion, you agree to be bound by these Terms.

These Terms incorporate the My Digicel App Terms and Conditions and Privacy Policy and the Digicel “Pick & Win” Promotion Terms and Conditions which you can access via the My Digicel App (the “App”).

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18), you should stop participating in the Promotion immediately.

What is the Digicel “Chwazi Pou Genyen Christmas 2024 Promotion”?

As part of our Christmas 2024 campaign, the Digicel “Chwazi Pou Genyen Christmas 2024” Promotion (the “Promotion”) allows Digicel customers users to win prizes through the Pick & Win gamification feature of the MyDigicel App (the “App”).

The Promotion allows you to
- PICK & WIN by completing specified activities to win prizes by unlocking boxes in the MyDigicel App (the “App”).
What is the promotional period?

The promotion starts on November 25th, 2024, and ends on December 31st, 2024 (the “Promotional period”
What is the Pick&Win?

Pick & Win is a gamification feature of the MyDigicel App that allows participants the opportunity to win prizes. Upon completing a Qualifying Activity, participants have the option of picking one of three boxes in the App for a chance to win a prize. Prizes will vary, and there is no guarantee that a participant will win a prize, subject to these Terms.
What activities qualify me to participate in Pick & Win?

Complete one of the activities below (“Qualifying Activities”) to participate in the Promotion:
- Prepaid Customers:
Purchase any of the prepaid plans below available on MyDigicel or *509#
- MonCash Customers
Be a registered MonCash user with no account restriction and/or suspension and purchase any plan via the MonCash Mobile app or *202#.
- Postpaid Customers
You must pay your bill on time and in full and have no outstanding balance on your accounts to be eligible.
Who is eligible to participate in Pick & Win?
- Digicel GSM (Mobile) prepaid customers
- Digicel GSM (Mobile) post-paid customers
- MonCash customers
- Must be at least 18 years to participate in the Promotion.
How does Pick & Win work?

Follow the steps below to participate:
- Complete a Qualifying Activity.
- Upon completing a Qualifying Activity, you will get instant access to “Pick & Win” in the App.
- Participate in Pick & Win in the App by picking the box of your choice. You must “Pick & Win” before your eligible plan expires.
- Redeem or gift your prize. Only the Telco Prizes can be gifted.
What are the chances of winning?
- - Participants are limited to one (1) win per day.
What prizes can I win if I participate in Pick & Win?

Prizes will be available as outlined below:

Participants will be limited to one (1) prize for "Cash Reward" prizes, major prizes, and the above gift card rewards. The same participant cannot win these prizes more than ONCE (01) during this promotion.
How can I gift my Telco prize?
- Only the Telco rewards can be gifted to another Digicel customer by selecting the “Gift” option when your prize appears on screen in the App.
- No other prize can be gifted.
How can I redeem my prize?
- You can redeem your telco reward immediately in the App.
- The Cash Rewards on MonCash will be transferred on the MonCash account of the winner after validation and/or verification in accordance with the terms and conditions below.
- To redeem any other collateral reward, contact the Digicel customer care or visit the main office with the smartphone you used to participate. You have a 30-day deadline to redeem any collateral reward. Passed this deadline, the reward will be made available in the prize pool for another participant to win.
Who cannot participate in the Promotion?

The following customers are excluded from participating in the Promotion:
- Post-paid Corporate & Business account customers.
- Post-paid customers with overdue amounts or inactive accounts
- Families of our employees.
- Employees and families of employees of any company associated with this Promotion, including but not limited to any provider of the Grand Prize
- People under the age of eighteen (18)
- People who do not reside in Haiti.
Can I participate in the Promotion while roaming?

This promotion is not accessible while roaming.

This promotion is limited to customers using eligible Digicel services in Haiti during the promotional period.
What will winners need to present to redeem their prize?

Winners must present a valid Government issued photo ID (passport, voter’s identification card or driver’s license) and the phone used to participate in the Promotion. The winner will be required to complete and sign a redemption form confirming their receipt of the prize and a Consent and Release Form authorizing the use of their picture (where they chose to do so) on social media.

Additional Terms and Conditions

This Promotion is offered for your personal use and not for commercial use and you agree not to sell any rewards redeemed through this Promotion.

The promotion will be advertised to customers via SMS, direct in-app notifications, digital ad placements, social media ads, radio spots, and displays in Digicel stores.

You are required to use a compatible smartphone to run the App and participate in the Promotion. A compatible smartphone is an Android (OS 4.0 or higher) or Apple (iOS 2.0 or higher) smartphone.

We reserve the right to disqualify you or terminate this offer if, in our sole opinion, the Promotion is being abused, such abuse to include but not be limited to selling or attempts to sell the prizes, whether on a commercial basis or otherwise, general abuse deemed as an attempt to undermine the integrity of our services.

You are solely responsible for all associated fees and costs incurred by you for redemption of prizes and for connectivity and data usage in relation to your use of the App.

The winners must have complied with these Terms and Conditions to enter and be on an active, qualifying contract with no accounts held with Digicel being in arrears to be eligible to win the prizes.

The Grand Prize is non-transferable, and Digicel reserves the right at any time to cancel, modify, or supersede the Promotion due to circumstances outside its control.

Upon accepting the Grand Prize, you accept the Grand Prize’s manufacturer’s Terms and Conditions associated with the Grand Prize and release us from any liability owing to defect or damage caused by or to the Grand Prize.

The manufacturer’s warranty and support information will be included in the packaging of the respective prizes when applicable.

We reserve the right to modify, suspend, extend, or discontinue (permanently or temporarily), this Promotion being offered to you at our discretion.

If a prize is unavailable, we may, in our discretion, substitute the prize with an alternative prize of equal value and/or specification.

Except where the choice is given to trade, prizes are not exchangeable and are not redeemable for cash.

We reserve the right to, at any time, with or without notice, vary or cancel the terms and conditions of this Promotion. In the event of us giving notice to you of any such changes to or cancellation of the Promotion, it shall suffice for us to give you notice via messages to your handset/device or to post such notification on the Digicel website or the App. Any such notification shall be effective immediately or as of the date referred to in such notifications.

Any personal data relating to participants will be used solely for the purposes of this Promotion by Digicel and/or by any agent or sub-processor duly appointed by Digicel to assist with mechanics, management, advertising, marketing, execution, or any other operation of the Promotion, for and on behalf of Digicel and will not be disclosed to any other third party for any other purpose without the individual’s prior consent.

By entering this Promotion, you consent to the use of your personal data by Digicel and/or any agent or sub-processor appointed by Digicel to carry out the Promotion. You further consent to Digicel's disclosure, use and publication of your name, nickname, image, voice, caricature, endorsement, signature, initials, reputation, autograph, address, country of birth and domicile, biographical data and/or likeness in connection with the exploitation, exhibition, distribution, advertising, publicity and promotion of the Promotion and the Digicel brand in all media, whether now known or hereafter devised, throughout the universe, perpetually and without restriction. Winners may share their winnings on their social media platforms and may be required to take part in related publicity, including (without limitation) publication of the name and image of a winner along with their winning entry via Digicel’s website, social media and other press and media channels. No payment will be given for this.

You agree to take part in any promotional, marketing or publicity activities or events reasonably requested by Digicel.  By participating in the Promotion, you consent to the use of your name, likeness, image, photograph for all programming and/or publicity or advertising purposes, commercial or otherwise, in all media and formats used by Digicel’s or its agencies, without further compensation, throughout the world in perpetuity. If you refuse to do so, you forfeit your right to claim the Grand Prize if you are the Winner.

Neither Digicel nor any other person or party associated with the Promotion, including affiliated companies, agents, contractors, sponsors, or any staff member involved in the Promotion, will be responsible in any way for any loss or damage incurred or suffered, death or bodily injury sustained, or costs incurred as a result of participating in the Promotion or claiming a prize, including the inability to claim and/or collect any prize in this promotion.

Digicel will not be responsible for the following:

1. technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections of network connections or hardware or software.
2. unauthorized human intervention by any party.
3. technical or human errors that may occur in the administration of this promotion.

In addition to these Terms and Conditions, you remain bound by our MyDigicel App Terms and Conditions of Use.
